These Terms of Use (the "Agreement") set out the terms on which Tapmochi Games ("Tapmochi" or "we") provides its games and services on the tapmochi.com website and through its mobile games (collectively, the "Service") to you, a user of the Service ("You" or "User").

By using the Service, You agree to comply with and be bound by this Agreement, which we may change at any time by posting notice on the Service.

1) Eligibility

You represent that Your use of the Service is not prohibited by law, and that You are old enough to use the Service under the age rating shown in the store listing of each game, or have permission from a parent or guardian. We may suspend or terminate Your access to the Service, with or without notice, if You breach any term of this Agreement.

2) Ownership of the Service and Related Intellectual Property

All the text, images, characters, marks, logos, music, data, other content, software and materials displayed on the Service or used by Tapmochi to operate the Service are proprietary to us or to third parties. Tapmochi expressly reserves all rights, including all intellectual property rights, in all of the foregoing, and except as expressly permitted by this Agreement, any use, redistribution, sale, decompilation, reverse engineering, disassembly, translation or other exploitation of them is strictly prohibited.

The marks displayed on the Service may not be used in connection with any service or products other than those provided by Tapmochi, in any manner that is likely to cause confusion, or in any manner that disparages or discredits Tapmochi.

3) License to Use the Service

Subject to this Agreement, Tapmochi grants You a personal, non-exclusive, non-transferable, revocable license to use the Service for Your personal, non-commercial entertainment. The Service is licensed, not sold. You may not remove any copyright, trademark or other proprietary notices placed in the Service.

You agree not to cheat, use bots, modify game files or memory, exploit bugs, or interfere with the Service, its ads or its servers. You are responsible for the device and Internet access needed to use the Service, and for any related fees (such as mobile data charges).

4) Virtual Items

Our games may include virtual coins, boosters, eggs, pets and other in-game items ("Virtual Items"). Virtual Items have no real-world value, cannot be exchanged for money, and are licensed to You only for use in the game. Game progress and Virtual Items are stored on Your device; they may be lost if You uninstall the game or clear its data, and we may change or rebalance them when we update a game.

5) Ads and Purchases

Our games may show ads served by third parties. Rewarded ads are always optional. If a game offers in-app purchases, they are billed and managed by the app store you bought them from (for example Google Play), under that store's terms and refund policy, and You will pay the applicable price and any related taxes.

6) Third-Party Services

The Service relies on third-party services (for example app stores, advertising and analytics providers), which have their own terms and privacy policies. The privacy policy of each game explains which services it uses.

7) Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8) Limitation of Liability

To the maximum extent permitted by applicable law, Tapmochi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data or Virtual Items, whether incurred directly or indirectly, arising from Your use of or inability to use the Service.

9) Termination

We may suspend or terminate Your access to the Service, or discontinue a game, at any time, with or without cause and with or without notice. Upon termination, the rights granted to You under this Agreement will immediately cease.

10) Changes to This Agreement

We may modify this Agreement at any time by posting the revised terms on the Service. Your continued use of the Service after such changes constitutes Your acceptance of the revised Agreement.
